Any legal proceeding can only get so far until service of process has been completed. There are two common errors experienced with service of process in NJ amongst less skilled process servers: serving the wrong person and not verifying the delivery.

Serving legal documents to the wrong person can be detrimental to the legal proceedings. Obviously this is a grave error in the business of process service. And yes, it does happen from time to time. The process server must visually confirm that the person they are serving is the individual the legal documents are intended for. Without a clear visual the service cannot and should not be completed or verified.

Proper filling out and filing of the Affidavit of Service is also essential to verifying service. This document is evidence that the documents were delivered in a timely manner using the appropriate methods and is unfortunately forgotten by the novice or ignored by the careless.
