Popular culture would have you believe that the average process server spends a significant amount of time thinking up elaborate disguises and ridiculous shenanigans to serve legal documents. Creativity and outside-the-box thinking are definitely necessary skills for the competent process server, however application tends to be more low-key.

A key skill in the world of process serving is the ability to blend into your surroundings. Evasive individuals are quick to avoid suspicious persons or those who notably stand out in an environment.

A process server may dress casually so as to appear neighborly when serving someone in their home. When serving at an office they will likely choose business casual, and if they are attempting service in a more formal situation then the best choice would be a nice suit. They certainly wouldn’t want to be dressed in a formal business suit at an outdoor sporting event.

Knowing whether or not their target individual is evasive by doing adequate background research impacts how far they will need to go to get those papers into the individual’s hands. A person who is not actively evading service will usually be easily served at home or work. An evasive individual, especially if they are particularly clever, will require a process server to get creative.

Creativity in service of process can take a myriad of forms. This can even be the ever popular movie trope of dressing up as a pizza delivery person. If the recipient regularly hits the gym your process server may dress in workout clothes to serve them there. Process servers have been known to dress as maintenance workers and door-to-door pest control salespersons. In some situations they may pose as a potential customer.

It is important to remember that it is illegal to impersonate an officer of the law in all 50 states. Also illegal is impersonating a government employee, USPS, FedEx, or UPS while serving process. Breaking the law while serving process would be detrimental to any legal proceedings and should never be an option.
