Can You Spot A Con Artist?

Masquerading as a process server can be fairly easy for a competent con artist. This is especially true when they imply a connection with law enforcement.

The counterfeit process server puts their target at risk for loss of money, identity, and personal security.

A valid process server will never collect money from the document recipient. This is the primary red flag to indicate that the person you are dealing with is not an actual process server but a con artist.

You will never be required to pay in order to maintain your due process rights. A con artist may threaten you with being held in contempt of court or even that you will have a warrant issued for your arrest if you refuse to pay them for the documents they are serving. However, process servers are paid by the person or entity that hired them to deliver documents, always.

A valid process server will never insinuate that monetary compensation will conveniently cause a failure to complete service.

A valid process server will not need excessive amounts of information. The job of a process server is to identify and locate document recipients for the person or entity that hires them. This may be a simple process, but can also be complicated depending on the wiles of an evasive recipient which would require extensive research.

A valid process server, when serving you documents, will want to verify your identity, complete service of process, and move on. You should not be required to share confidential information such as your social security number or bank account information. You should never feel harassed or intimidated.

A valid process server will behave in a professional manner. They should be able and willing to answer your questions and be comfortable to work with. They should be familiar with a variety of different legal documents. Beware of a process server that cannot easily locate the docket number on your paper or cannot produce the case number or identify the courthouse where your case has been filed.
